Terms of Service

These terms govern your use of Atrium, a service operated by WAVIISoft, LLC ("we", "us"), a Washington limited liability company. By using Atrium you agree to them. If you do not agree to them, do not use the service.

Your account

Accounts are created by invitation rather than open sign-up, and an account is for one person. You must be at least 18 years old to use Atrium.

You sign in with a passkey held on your own device, so keeping that device and its unlock method secure is what keeps your account secure. Tell us promptly if you believe someone else has reached your account.

You are responsible for what is done through your account.

Your content

What you put into Atrium stays yours. We claim no ownership of your jots, your topics, or anything your connected sources bring in.

We need a narrow permission to run the service at all: to store your content, to display it back to you, and to process it so the product can do what it is for — including sending relevant text to the model provider your deployment has configured, as described in the Privacy Policy. That permission exists only to operate the service for you, and it ends when you delete the content or close your account.

Acceptable use

Do not use Atrium to break the law, to infringe someone else's rights, or to store or distribute malware. Do not attempt to reach another account's data, to probe or disrupt the service's infrastructure, or to circumvent its access controls or usage limits. Do not resell access to the service.

Connect only accounts you are entitled to connect, and only bring in data you are entitled to hold.

Connected services and third parties

Connecting GitHub, Microsoft 365, or Google is optional, and each connection is governed by that provider's own terms as well as these. We are not responsible for a third-party service's availability, or for what it does with the data you hold there. The waitlist and feedback forms are hosted by a third-party form provider, and what you submit through them is handled under that provider's terms rather than these.

What the models produce

Atrium uses models to suggest topic names, propose where an item belongs, and summarise. That output can be wrong. It is offered as a suggestion for you to accept or reject, never as a statement of fact, and it is not professional advice of any kind. Decisions you make on the strength of it are yours.

Availability and change

Atrium is under active development. Features may be added, changed, or removed, and the service may be unavailable at times, planned or otherwise. We do not promise a particular level of uptime.

Keep your own copies of anything you cannot afford to lose.

Ending it

You may stop using Atrium at any time and ask for your account and its data to be deleted. We may suspend or close an account that breaches these terms, or where we are required to. When an account closes, its content is deleted.

Our intellectual property

Atrium's software, design, name, and marks belong to us. These terms give you permission to use the service; they transfer nothing else.

Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost revenue, or lost or corrupted data. Our total liability arising out of or relating to these terms or the service will not exceed the greater of the amounts you paid us for the service in the twelve months before the claim, or one hundred U.S. dollars.

Nothing in these terms limits liability that cannot lawfully be limited, and nothing in them waives any right you have under the Washington Consumer Protection Act or other consumer protection law that cannot be waived by agreement.

Governing law and where disputes are heard

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to them or to the service will be brought in the state or federal courts located in Washington, and you and we each consent to the jurisdiction of those courts.

This does not deprive you of the protection of any mandatory consumer law of the place where you live, or of the right to bring a qualifying claim in small claims court.

The rest of the agreement

If any provision of these terms is held unenforceable, the rest stays in force and that provision is narrowed only so far as needed. Our not enforcing a provision on one occasion is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Together with the Privacy Policy, these terms are the entire agreement between you and us about the service, and they replace any earlier understanding about it.

Changes to these terms

If these terms change, the date at the top changes with them. Continuing to use Atrium after a change means accepting the revised terms, so that date is worth checking.
